Sports Europe Terms and Conditions
We strongly advise you to check your cover if you buy your own travel insurance. Sports Europe does not accept liability in the event of flight cancellations to or from your destination nor for any costs incurred should you be unable to return to the UK or country from where your flight originated.
Force majeure
Except where otherwise expressly stated in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage, loss or expense of any nature as a result of “force majeure”. In these booking conditions, “force majeure” means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include actual or threatened war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire, closure, restriction or congestion of airspace, airports and ports and all other events outside our control. Force majeure also includes the UK Foreign Office advising against all travel or all but essential travel to any country, region or destination.
You should also carry a European health insurance card www.ukehic.com/ when travelling within the European union. You are strongly advised to read through the terms of any personally arranged insurance policy before departure, especially regarding pre-existing medical conditions for those whose health would affect your ability to travel. It is your responsibility to ensure any insurance taken out by you meets your personal requirements. Participants with any medical problems are strongly advised to consult their doctor before embarking on any tour, and to advise the doctor of any activities which they will participate in. Good time should be allowed should any immunisations be required.
Once you have confirmed that you wish to proceed, we will e-mail you with an invoice for a deposit of 30% of the total price. This should be paid within 28 days of your decision to go ahead. However, certain places, e.g. Center Parcs, may require a deposit sooner than this. We will also require the names of you (the group leader) and each member of your group for hotel bookings. Please note that if we do not receive the deposit and list of names within 28 days we cannot guarantee that your trip will go ahead, as certain types of accommodation require booking within that time frame.
The invoice for the remaining balance will follow with your confirmation of payment received and should be settled no less than 40 days prior to your proposed departure date. However, certain places e.g. Center Parcs, may require the outstanding balance sooner than this. If that is the case you will be notified at the outset. The group leader is responsible for making all payments due to us. The group leader must be at least 18 years of age and must be authorized to make the booking on the basis of these booking terms and conditions by all the persons in the group. Please check and confirm all details of your final itinerary immediately on receipt. You must contact us within 14 days of the date on your final itinerary email if any information appears to be incorrect, as it may not be possible to make changes later
Prices
Due to unparalleled movements in the world’s currency exchanges, Sports Europe reserves the right to amend the GBP prices published on our internet page to reflect such movement.
We hope this situation will stabilize soon, however, for clarity, Sports Europe can itemise this on your final invoice as an ”Exceptional Exchange Rate Charge”.
We reserve the right to make changes to and correct errors at any time before your tour is confirmed. Once the price of your tour has been confirmed at the time of the booking, we will only increase or decrease it in the following circumstances. Increases or decreases after booking, will be passed on by way of a surcharge or refund.
The relevant circumstances are:-
1) Transportation costs, eg fuel, scheduled airfares
2) Charges due in taxes or fees payable for services
3) Changes in the exchange rates which have been used to calculate the cost of your tour.
In the above cases, only if the amount of the increase in our costs exceeds 2% of the total cost of your tour (excluding insurance premium) will we levy a surcharge. If any surcharge is greater than 10% of the cost of your tour (excluding insurance premium) you will be entitled to cancel your booking and receive a full refund of all monies you have paid to us or alternatively purchase another tour from us.
You have 7 days from the issue date printed on the surcharge invoice to tell us if you want to cancel or purchase another tour. If you do not tell us that you wish to do so within this period of time, we are entitled to assume you will pay the surcharge. Any surcharge must be paid with the cost of the balance of the cost of the tour or within 14 days of the issue date of the surcharge invoice, whichever is the later. We promise not to levy a surcharge within 30 days of the start of your tour.
Cancellation Charges
Cancellations for any reason must be made in writing only via e-mail or by letter by the group leader. If any member of the group wishes to cancel, the remaining passengers in the group must pay any increased charges due to the cancellation, e.g. under-occupancy charges.
In the event of a cancellation we will refund the following amounts:
All deposits are non – refundable.
Balance (if received) refunded if notification received more than 30 days prior to tour start date.
If balance is not received at least 40 days prior to tour start date we reserve the right to cancel your booking and retain full deposit.
The shortfall and deficit created by one or more cancellations must be met and borne by the remaining travellers.
Cancellations will not be made by us less than 30 days prior to tour start date except in the event of non payment of balance or situations arising which are beyond our control such as threats or acts of war, civil unrest, terrorist activity, industrial dispute, natural disaster, industrial disaster, technical problems to transport, closure or congestion of airports or ports, severe weather conditions or any unforeseen circumstances attributable to acts of God or force majeure.
Liability
Sports Europe accepts liability for illness, injury or death to yourself or anyone in your party, only if it is as the result of negligence by any of our staff, agents, suppliers or their employees while acting in the course of their employment or contract of supply.
We cannot accept liability in any circumstances where performance of our obligations is prevented by reason of war, threat of war, riots, civil strife, terrorist activities, industrial disputes, natural and nuclear disaster, fire or adverse weather conditions.
We do not accept liability where boarding or entry is refused for the following reasons: lateness of arrival for check-in; failure to hold a valid passport, or insufficient funds; if in the opinion of a person in authority you appear unfit to travel, or are likely to cause discomfort or disturbance to other passengers; if you fail to co-operate with airport authorities. In any of the above circumstances we will not be responsible for any costs you may incur, nor will a refund be made.
Flight times are subject to alteration and delay for reasons or events outside our control. We cannot accept responsibility for any expenses incurred in this event. However, holiday insurance provides cover in the event of an extensive delay.
Sports Europe uses a wide range of service providers for transport, accommodation, and activities. Each service provider is, and not the company, deemed to be responsible for the group while it is in their care. All services are provided subject to the provider’s own conditions. You are deemed to have accepted these conditions, which are available on request directly from the supplier.
All our descriptions of areas, resorts and accommodation are as accurate as possible. However, please bear in mind that some facilities change or become unavailable due to events beyond our control. We will try to keep you advised of any changes, but we do not accept liability for them. Please remember that you are visiting a foreign country and should accept that certain aspects are different to the UK: food, climate and customs. You should be aware that ants, flies, cockroaches, mosquitoes and other insects thrive in warmer climates. Sports Europe does not accept liability for any disappointment in this regard.
Sports Europe reserves the right in its absolute discretion to terminate without notice the travel arrangements of any group member whose behaviour or actions cause, or are deemed likely to cause, distress, damage or danger to other group members, employees or suppliers of Sports Europe, or any third party. In the event of the tour being terminated for a group member, members or group due to unacceptable behaviour, the company shall be under no liability to pay any refund or compensation costs incurred by the group or group member. Furthermore, the group leader and the group agree to indemnify Sports Europe against any costs or claims made by its service providers or any third parties that result from any damage or unacceptable behaviour.
Sports Europe will not be held responsible should any group member suffer personal injury, illness or death by misadventure on the tour, unless the event occurs as a result of negligence of the company. Nor will it be held responsible should such an event be caused through the fault of another group member or any other third party not employed by the company. Nor will it be liable should such an event occur as the result of an activity which does not form part of the itinerary or activities, unless such event occurs as a result of negligence of the company. However, Sports Europe will do everything reasonable to assist the group should such circumstances occur.
Complaints
If an individual group member or the group has a complaint, Sports Europe requests that the group leader immediately notifies the service provider concerned (transport company, hotel etc.) This will enable the matter to be resolved on the spot. If that is not possible, or if the complaint is not resolved, then the group leader should contact us on return. Please write within 28 days of your return to the UK, enclosing a report from your local representative, (if applicable). We will investigate the complaint on your behalf, and a full and precise response will follow within 28 days, provided we have been able to investigate your claim fully in that time. Unfortunately, we cannot deal with any complaints that are received after the 28 day period, or which do not have an accompanying statement from the local representative if there was one.
Changes to Arrangements
In the unlikely event that we have to change any aspect of your travel arrangements we will notify you in writing at the earliest possible opportunity. These changes are usually minor. In the event that we have to change your accommodation, we will endeavour to place you in a residence of equal or superior quality at no additional charge. Should any of the changes not meet your requirements you have the choice of i) changing your selected tour with us (which may be subject to additional costs or a partial refund depending on the choice of tour) or ii) advising us of the cancellation of your booking whereby you will receive a refund of all moneys paid less any applicable administrative charges. The prices stated on your confirmation invoice are guaranteed and will not be subject to additional charges incurred due to tax increases etc. Sports Europe do however reserve the right to change the prices of the tours stated on its website and other company literature at any time and without prior notice.
Passports and Health Requirements
It is your responsibility to ensure you have a passport with at least 6 months validity remaining on arrival in your destination. You should allow a minimum of six weeks when applying for a new passport. We regret we cannot accept any liability if you are refused entry into the country or onto any transport due to failure on your part to carry correct documentation such as passports and medical certificates such as E111.
Website
Your use of the Sports Europe website and submittal of an enquiry form does not constitute a contract or other agreement between you and us. You may not modify, copy, distribute, display, reproduce or publish or sell any information or services obtained from the website. Whilst we take reasonable steps to exclude viruses from the website, we cannot guarantee such exclusion and no liability is accepted for viruses. Material featured on the website is provided on an ’as available’ basis. Descriptions given may be based on inspections made on our behalf, and on information passed on to us. Descriptions are therefore of what normally exists at a given destination or venue. Further, facilities and amenities may be affected by local conditions such as adverse weather. Sports Europe therefore does not give any warranty that the material on the website is complete, accurate or up-to-date at all times.
Security
Each group member is individually responsible for his or her own personal behaviour while on the tour. However, the group leader hereby accepts responsibility for the overall behaviour and welfare of the group. All children under the age of 16 years must be accompanied by an adult, or designated adult responsible for their welfare and safety. The group leader agrees that he or she has read and understood the terms and conditions contract and will abide by it. This agreement applies to all members of the group, and he or she is responsible for explaining the terms and conditions to all group members, and is also responsible for any group member breaking the terms of this agreement.
